TERMS & CONDITIONS
Sessions include: One (1) hour session, One (1) outfit, One (1) location. If you want more than one outfit or location there will be additional charges.
The client grants Jeanna Goodpasture (Hereinafter referred to as “the Photographer”) permission to use the resulting work ("the Work") according to the terms stated hereunder:
1. Deposits and Payments
The client shall make a non-refundable deposit (Hereinafter referred to as “the retainer”) to retain the Photographer for agreed upon services on a set date and time. The retainer will be used towards the clients remaining balance on the date and time of the agreed upon services. Balance is to be paid in full at the time the services are provided. Cancellations of services will result is the loss of retainer. Beng 30 minutes late to your scheduled session is an automatic cancellation of your session and a loss of your session retainer.
Sessions will only be rescheduled due to inclement weather the day of your scheduled session.
Location will be agreed upon when your session has been confirmed for the set date and time you have chosen. At no time can the location be changed after the retainer has been paid.
4. Copyright and Reproduction
The Photographer shall own the copyright of the Work and shall have the exclusive rights to all the Work. This includes all rights in the Work which shall accrue to the benefit of his/her successors, legal representatives and assigns. The Work will be edited without restrictions. This may include the Work being altered, distorted, used in whole or in part, in conjunction with other images, graphics, text and sound in any way whatsoever and without restriction.
The Work will be used for the Photographer’s portfolio, advertising and promotional purposes of the Photographer, Jeanna Goodpasture DBA Tiffany Brooks Designs. This includes but is not limited to the Work being used on Tiffany Brooks Designs website, blog, and various social media accounts for any and all advertising needs. Permission herein granted is absolute and final and shall not be subject to further inspection or approval by the client at any stage in the use of the Work.
5. Client’s Usage
The client may use the Work for personal use only and shall not sell the Work. The client will be emailed the Work and receive a print release giving permission to print the Work in any quantity and size.
The client releases the Photographer from any liability in the event that an injury or allergic reaction occurs during or after the photoshoot. The client acknowledges that when shooting outdoors the client is subject to insect bites, weather conditions, and injury.
This Agreement shall be construed, interpreted and governed in accordance with the laws of the State of North Carolina and should any provision of this Agreement be judged by an appropriate court as invalid, it shall not affect any of the remaining provisions whatsoever.
Any permission granted to the Photographer shall extend to his/her successors, legal representatives, licensees and assigns and shall be irrevocable and perpetual without any further or additional claim for compensation by the client.
The client agrees that any or all parts of this agreement may be submitted to the other party in legible and recordable electronic form and upon acknowledgement of receipt by the receiving party shall become valid parts of the agreement.
